"articleBody": "Across our matrimonial casework, one pattern has been unmistakable through 2025 and the first half of 2026: enquiries from spouses who suspect infidelity are rising, and they are arriving earlier and with more digital evidence attached than at any point in the last decade. Czech family lawyers report the same shift. The question we are asked most often is whether people are genuinely being unfaithful more frequently, or whether they are simply being caught more often. In our experience the honest answer is both. What is driving the increase Three forces overlap. First, remote and hybrid work has dissolved the natural alibi structure of the working week. A partner who is unaccounted for between nine and five no longer has to explain anything, and unmonitored midweek daytime hours are where most of the meetings we document actually take place. Second, dating and messaging platforms have made initiating contact effortless and deniable, with disappearing messages, secondary accounts and archived chat folders now routine features of the cases we handle. Third, economic pressure has strained households: financial stress is one of the strongest predictors of marital breakdown, and Czechia has spent two years absorbing weak real income growth alongside stubborn housing costs. What the digital trail actually proves Clients frequently arrive convinced that a screenshot settles the matter. It rarely does. A message thread demonstrates communication, not a relationship, and it is often inadmissible or legally hazardous if it was obtained by accessing a partner's device or accounts without consent. Under Czech law and the GDPR, unlawfully obtained material can compromise the whole case and expose the person who collected it. This is the single most common mistake we correct in an initial consultation: the evidence that feels most conclusive to a spouse is frequently the evidence that a court will not consider. What a lawful investigation can establish A properly run matrimonial investigation works from public-space observation and open-source research. Our operatives document movements, meetings and patterns of behaviour in places where there is no reasonable expectation of privacy: streets, restaurants, hotel entrances, car parks. Reports are built around timestamped photography, contemporaneous logs and a documented chain of custody, with each observation attributable to a named operative. That structure is what allows counsel to place the material in front of a court, and it is why a two-week structured surveillance package is usually worth more than two years of a spouse's own suspicions. Why it matters beyond the marriage Czech divorce proceedings do not require proof of fault to dissolve a marriage, so infidelity alone rarely decides the outcome. Its practical significance is usually financial and parental. Where an affair coincides with unexplained spending, gifts, transfers to a third party or the movement of funds out of the marital estate, the surveillance record and the financial record together become an asset tracing matter, and that does affect settlement. Where a new partner is present around children, the relevant question for the court is not the affair but the child's welfare and the safety of the arrangements, which is a litigation support and evidence question rather than a moral one. Practical guidance if you suspect a partner Do not confront early. Once a suspicion is voiced, behaviour changes, devices are cleaned and the opportunity to establish anything reliable narrows sharply. Do not install tracking software, read a partner's messages or place recording devices in shared spaces; these steps are criminal risks that routinely destroy an otherwise strong case. Do write down what you have already noticed, with dates, because your own contemporaneous notes are useful context for an investigator. Then take advice before acting. Our matrimonial investigation service begins with a confidential consultation in which we assess whether surveillance is proportionate, likely to produce usable evidence, and worth the cost in your particular circumstances. Sometimes the responsible recommendation is not to proceed, and we say so. Infidelity cases are rarely about catching someone. They are about restoring a person's ability to make decisions on the basis of facts rather than fear. That is what a lawful, well-documented investigation delivers. # Why Infidelity Is Rising in Czech Marriages, and What the Evidence Shows

By Exero Group · Exero Group, Prague

![Wedding ring and a face-down smartphone on a café table with a blurred Prague skyline through the window](https://akreodypygwbrmmgpmsq.supabase.co/storage/v1/object/public/blog-images/posts%2Finfidelity-czech-marriages-2026.jpg)

Across our matrimonial casework, one pattern has been unmistakable through 2025 and the first half of 2026: enquiries from spouses who suspect infidelity are rising, and they are arriving earlier and with more digital evidence attached than at any point in the last decade. Czech family lawyers report the same shift. The question we are asked most often is whether people are genuinely being unfaithful more frequently, or whether they are simply being caught more often. In our experience the honest answer is both.

## What is driving the increase

Three forces overlap.

## What the digital trail actually proves

Clients frequently arrive convinced that a screenshot settles the matter.

## What a lawful investigation can establish

A properly run matrimonial investigation works from public-space observation and open-source research.

## Why it matters beyond the marriage

Czech divorce proceedings do not require proof of fault to dissolve a marriage, so infidelity alone rarely decides the outcome. Its practical significance is usually financial and parental. Where an affair coincides with unexplained spending, gifts, transfers to a third party or the movement of funds out of the marital estate, the surveillance record and the financial record together become an [asset tracing](/services/data-intelligence) matter, and that does affect settlement. Where a new partner is present around children, the relevant question for the court is not the affair but the child's welfare and the safety of the arrangements, which is a [litigation support](/services/legal) and evidence question rather than a moral one.

## Practical guidance if you suspect a partner

Do not confront early. Our [matrimonial investigation service](/services/surveillance) begins with a confidential consultation in which we assess whether surveillance is proportionate, likely to produce usable evidence, and worth the cost in your particular circumstances. Sometimes the responsible recommendation is not to proceed, and we say so.

Infidelity cases are rarely about catching someone. They are about restoring a person's ability to make decisions on the basis of facts rather than fear. That is what a lawful, well-documented investigation delivers. If you would like to discuss a situation in confidence, [contact our team](/contact).
